Drone Videography Rules and Permits in Malaysia

What commercial drone work in Malaysia actually requires, the airspace and lead time realities, and how to plan aerial shots that will survive the schedule.

Aerial footage is the most requested and least planned element in Malaysian production briefs. Clients ask for a drone shot the way they ask for a wide shot, and drone operation is a regulated aviation activity with operator requirements, aircraft requirements and airspace constraints. Treating it as an equipment choice rather than as a permission problem is why aerial shots are so often the item that gets cut on the day.

The first thing to establish is that commercial drone work is regulated differently from recreational flying. Operating for payment, for a client, or as part of a commercial production brings requirements around the operator's authorisation, the aircraft's registration and the specific flight, and the fact that a device is available in a consumer shop says nothing about whether a given flight is permitted. Productions should confirm that their operator holds current authorisation rather than assuming it, because liability for an unauthorised flight does not stay with the pilot alone.

Airspace is the constraint that most often blocks a shot, and it is location specific rather than general. Proximity to airports and aerodromes, controlled airspace, and restricted areas around sensitive installations all impose limits, and much of the Klang Valley sits in airspace where approval is required rather than assumed. The practical step is to check the specific coordinates early, at recce stage, rather than discovering the restriction when the drone is already on site.

Lead time is the second constraint and it is routinely underestimated. Where approval is required it is a formal process measured in weeks rather than days, and it is tied to specific dates, locations and flight parameters. A production that finalises its shoot date two weeks out and then applies is likely to be flying without the approval or not flying at all. Beginning the application at pre production, alongside location permits, is what makes aerial work reliable.

Location permission is separate from airspace permission and both are needed. The owner or manager of the property being filmed, and often the property being flown over, has to agree, and many commercial venues, developments and industrial sites have their own policies regardless of what aviation regulation permits. A development site typically requires the developer's written approval and evidence of insurance covering aerial operations specifically, which standard production insurance may not include.

Weather is the operational reality that shapes the schedule. Wind limits ground drones more often than rain does, and the monsoon influences both. Because approvals are usually tied to specific dates, a weather cancellation can require reapplication rather than a simple reschedule. Requesting a permitted window rather than a single day, where the process allows it, converts a weather problem from a lost approval into an inconvenience.

The shot planning question worth asking is what the aerial actually contributes, because a substantial proportion of drone footage in corporate video is decorative. The shots that earn their cost are the ones that communicate something no ground camera can: the scale of a facility, the relationship between buildings on a site, the context of a development within its surroundings, the extent of an operation. A slow rise over a car park communicates nothing and is the most commonly delivered aerial shot in the category.

There are legitimate alternatives when the permission or the weather does not cooperate, and planning them in advance rather than improvising is what protects the delivery date. For context and establishing shots, 3D built environments and generated aerial perspectives can carry the same information, particularly for developments that do not yet exist. Poushneh (2021) found that perceived proximity to a virtual product influenced purchase intention, which supports the use of constructed aerial context where the purpose is to convey scale and setting rather than to document a specific real moment.

The boundary to observe with constructed aerials is the same one that applies elsewhere: they work where the audience understands the image as illustrative, and they create a problem where the shot functions as evidence that a facility, a development or an operation exists at a stated scale. For property marketing in particular, an aerial that shows a surrounding context different from reality is exactly the kind of discrepancy that generates complaints later.

The planning summary for a production office is short. Confirm the operator's authorisation, check the airspace status of each specific location at recce, begin approvals with the same lead time as location permits, confirm insurance covers aerial work, tie each aerial shot to a purpose that a ground camera cannot serve, request a date window rather than a single day, and hold a defined fallback for every aerial in the shot list. Productions that do this get their aerials. Productions that add drone to the equipment list and hope generally do not.
